On Friday, a Federal Capital Territory High Court struck out a claim for fundamental human rights brought by Sa’adatu Yaro, a member of staff at the Central Bank of Nigeria, against the Department of State Services.
The lawsuit demanded both bail from continuing arrest and an order freeing her six exotic cars that were seized by the secret police on July 12.
Yaro is the second defendant in the N6.9 billion procurement fraud lawsuit brought by the Federal Government against suspended CBN governor Godwin Emefile.
Yaro’s absence halted the start of the trial on Thursday.
However, in a notice of motion stamped FCT/HC/CV/6918/23, Yaro, represented by J.B Daudu SAN, asked the court to declare her arrest on July 12, 2023, as well as her husband’s incarceration and confiscation of her six exotic cars, as violations of her fundamental human rights.
Daudu further claimed that the DSS lacked jurisdiction and legislative authorities to investigate the applicant’s business transactions because it was not an anti-graft agency.
He said the continuous detention and torture of the applicant by the DSS since the 12th day of July 2023 violates the applicant’s Right to Dignity of Human Person and Right to Personal Liberty guaranteed by Sections 34 & 35 of the 1999 Constitution of the Federal Republic of Nigeria.
