Hollywood actor Jamie Foxx is facing a lawsuit accusing him of sexually assaulting a patron at a rooftop bar in New York back in 2015. The plaintiff, identified as Jane Doe, claims that Foxx took her to a secluded area of the Catch NYC rooftop lounge, where he allegedly rubbed her breasts and groped her beneath her pants without her consent.
According to the lawsuit, the incident occurred when the woman and a friend were seated at a table next to Foxx and Mark Birnbaum, the bar’s owner. Around 1 a.m., the woman’s friend asked Foxx for a photo, which he agreed to, and they took several pictures. Foxx then reportedly complimented the plaintiff, making remarks about her body and scent.
The lawsuit further alleges that Foxx escorted her to a more private part of the rooftop, where he allegedly groped her breasts under her crop top. The plaintiff claims she was taken by surprise and attempted to step away, but Foxx proceeded to put his hands down her pants, touching her vagina and anus. A security guard purportedly witnessed the incident but did not intervene. The plaintiff’s friend eventually found her, prompting Foxx to stop and walk away.
The legal action seeks compensation for pain, suffering, emotional distress, anxiety, and humiliation. It asserts that the woman experienced physical discomfort and required medical treatment due to the alleged assault. The lawsuit also implicates Birnbaum and Catch NYC as defendants, accusing them of enabling the assault and failing to adequately supervise their staff.
This lawsuit is among several filed under New York’s Adult Survivors Act, which created a one-year window for filing sexual abuse claims not covered by the statute of limitations. The deadline for such claims is Thursday.
