CSU: Supreme Court rejects Atiku’s bid to tender fresh evidence against Tinubu
As the hearing of petitions brought by Atiku Abubakar and Peter Obi against the election of President Bola Tinubu gets underway, the Supreme Court has rejected Atiku’s request to tender fresh evidences against President Tinubu.
Reading the court’s verdict Justice Inyang Okoro said that no amendment can be made to introducing new facts that was not contained in the election petition.
“no amendment can be made introducing new facts not contained in the election petition” as stated in section 132(7) of the Electoral Act. This application clearly runs foul of the Electoral Act,” he said.
Justice Okoro said that the court will not be taking fresh evidences that were not tendered within the 180 days cyce given for the tribunal proceeding.
The court held that even though the deposition is very critical, it would not be admitting it.
The petition’s strongest point was thought to be Atiku’s forgery charge against Tinubu. However, given the court’s refusal to accept the evidence, President Tinubu appears to be on his way to triumph in the Supreme Court.
