Court remands two in prison over sale of unregistered cosmetics

 

Justice Yellim Bogoro of a Federal High Court sitting in Lagos on Monday, ordered the remand of two defendants Friday Chieze and Kingsley Nnam in the correctional service.

The defendants were arraigned by the National Agency for Food and Drugs Administration and Control (NAFDAC), on a three-counts charge bordering on the alleged sale of unregistered body spray.

After listening to the charge preferred against them, they pleaded not guilty to the charge.

After their pleas, defence counsel Mr Kingsley Onyemaechi, moved his application for bail of the defendants which was not opposed by the prosecutor, Mrs Ngozi Emma-Afoke.

Consequently, Justice Bogoro adjourned the case until July 1, for ruling on the bail application and ordered the defendants to be remanded at the Nigerian Correctional Service pending bail.

According to the charge, the defendants were alleged to have committed the offence on January 18, at the Trade Fair complex area of Ojo in Lagos.

The prosecution alleged that the defendants sold cosmetic products known as Riggs Body Spray without registration.

She alleged that the defendants stored and distributed the unregistered products, which contain substances likely to cause injury to the health and safety of unsuspecting users.

The offence contravenes the provisions of Section 1(1), 1(4) and 6 of the Food, Drugs and Related Products (Registration) Act 2004.
