The Court of Appeal in Abuja has set aside the judgment of the National and State House of Assembly Election Tribunal which recognised Ndudi Elumelu of the Peoples Democratic Party (PDP) as winner of the Aniocha/Oshimili Federal Constituency.
The Tribunal had sacked the INEC’s declared winner, Ngozi Okolie of the Labour Party and declared Ndudi Elumelu, candidate of PDP as winner of the 2023 election.
In the judgment on Thursday, the appellate court affirmed that Ngozi Okolie is the winner of the election of Aniocha/Oshimili Federal Constituency.
Elumelu had challenged the Labour Party primary that produced Okolie as LP’s candidate, saying he was not duly sponsored because, at the time of the primary election that produced him as the candidate, he (Okolie) was not a member of the party.
